  • In massachusetts, what happens if I refuse to divorce my spouse?

    Basic question

    Barbra’s Answer

Massachusetts permits either party to file for divorce on a no fault basis known as "irretrievable breakdown of the marriage". One spouse cannot prevent the other from filing for divorce and ultimately obtaining a divorce. All divorce complaints are assigned to a fourteen month "track" which means that the process can take some time, though a divorce will be granted at some point, either as the result of an agreement of the parties or a Judgment entered after trial.
