    I am sorry that you are going through this in monst state personal property and real property is not easily modified, however your divorce/separation agreement controls. However, if there was fraud that may change things, please sit with a local attny and review the facts, take good care.

    I am sorry that you are going through this, it depends upon the document in most cases courts use survival or merger or like kind language, some things like child related issues may be modfied, some issues like property division or spousal support cannot unless their is a material change in circumstances and the language controls, take care

If you she had any estate planning that may control and even if she did the court does have some authority to help you, review the specifics, the exact connections etc with a local attorney or your local court, more than likely it will work out, take good care and I am truly sorry you are going through this.

    I am sorry that you are going through this, to avoid the contempt the best situation for a case like this is to do your best to explain why the test may have been a false positive, perhaps there are other factors at play here, if posible please chat with a local attny and he or she may have some ideas, or perhaps you may negotiate your weight out. take good care and be careful.

    congratulations- your state is community property, however if nothing is filed, nothing beside the big guy/girl upstairs is stopping you from spending the money as fast as you can, but if you buy tangible stuff, cars boats etc then if a divorce is filed that stuff becomes part of the marital estate. Or you could cash the check, spend or hide the money and really have to deal with the ethical consequences, however it would be hard to put that toothpaste back in the tube. Do what is best and what is right, life is short, use the money in a way you woudl be proud of, take good care and be well.

    I am sorry that you are going through this, if nothing is filed and given the facts you presented you may and should move away from the abuse. Once anything is formely filed in court you may have a harder time. wherever you end up, you should immediatley file first and state the reasons so that if that state statute/laws allow an abused spouse with children to file as an exception to the jurisdictional/time requirements you will have been protected. Most states have exceptions for child related/protective issuses, take good care and I wish you and your child all the best in the world, be happy and be safe.
