Yes. If the matter is dismissed at the magistrate level, no record will appear for your son. It is well worth the expense of an attorney to prevent any entry on your son's record. I would not recommend driving on a suspended license. In Massachusetts this is a criminal infraction. You could get stopped for any number of reasons beyond having your plates run. Also, depending on what your license is suspended for, you could be looking at jail time. If driving is a necessity, you should apply to the registry board of appeals for a hardship license, an in the meantime have someone else drive you.

You can have an attorney file an appearance on your behalf at any time. Once the attorney has filed an appearance they can file a motion for temporary orders and get into court very quickly if there is no order already.

For the purpse of suspensions the rmv uses conviction date, not offense date. Where the languid are states "shall occur" you may be able to argue this to the hearings officer or rmv board of appeals. If you are unsuccessful you can take the driving class to avoid loss of license for 3 surcharge able offenses.

Go to the court as soon as possible with all the paperwork. Where you were in the hospital and have proof of that, the court should remove the warrant and reschedule the date for you.
