BENJAMIN ALPER AND HOWARD WEINTRAUB ARE PHENOMENAL CRIMINAL DEFENSE LAWYERS WHO SAVED ME
Several months ago, while I was driving my car in Georgia, I was pulled over in the afternoon by a police officer who claimed I had an improper level of tint in my windows. After speaking with me and the passengers in my car and with the officer claiming that he smelled an odor of marijuana, my passe...ngers and I were ordered out of my car. A search of my car then took place and the police found a quantity of marijuana in the trunk, together with a firearm and a weighing scale. Although these items did not belong to me, the officer arrested me and I was facing felony charges of being in possession of a firearm during the commission of a drug offense and possessing marijuana with the intent to distribute. Although my car was occupied with two passengers, the police placed criminal liability on me.
As a young college graduate with a promising career ahead of me in the legal profession, I knew that this day had become a life-changing moment for me and I knew that I needed to retain formidable criminal defense lawyers in Atlanta to help me through this crisis. After making the dreaded telephone call from jail to my parents to advise them of my arrest (my first lifetime arrest) my parents searched for a criminal defense lawyer. At approximately 11 p.m. that evening my mother emailed the Law Offices of Howard J. Weintraub in Atlanta briefly stating my situation and requesting a call from the attorneys when the office opened the next day. To my parents’ amazement and relief, they received a telephone call from Attorney Howard Weintraub himself within a few minutes from when the email had been sent! Howard Weintraub spoke with my parents concerning the legal procedure that I was facing and he took great care at the midnight hour to allay their fears and anxiety. Mr. Weintraub discussed with my parents the law concerning vehicle stops and vehicle searches, and discussed other matters with them. Mr. Weintraub also commiserated with my parents about the devastating impact of the arrest on my future career and he offered relief to my parents by generating a plan – if it worked – that would enable me to forgo a conviction and have the arrest expunged from my record. Although he was careful not to guarantee this result, he was hopeful that he could pull it off. Guess what? Howard Weintraub and his partner Benjamin Black Alper pulled it off!
Howard and Ben hit the ground running the next day after I made bail and was released from jail. First, Ben and Howard met with me in their midtown Atlanta office for a conference that took several hours. At this meeting, Ben and Howard went through the facts of my case in painstaking detail. They also took the time and effort to learn about me and my background so that they could explain to the prosecutor that I was not a criminal. After the meeting I felt relieved and I was so thankful to have not one but two smart and tough lawyers in my corner.
Howard and Ben routinely kept in touch with me about my case and their progress. Howard and Ben explained that the first step would be to get the felony charges reduced to misdemeanor charges. The prosecutors initially offered to let me plead guilty to the felony charges with a sentence of five years of probation. Howard and Ben would not accept that. After a few more rounds of negotiations, Howard and Ben convinced the prosecutor to drop the charges to misdemeanors. A second prosecutor then came onto my case and offered to let me plead guilty to the misdemeanors with a sentence of one year probation. Howard and Ben would not accept that. After further negotiations and a lengthy presentation to the prosecutors about my character and background, Howard and Ben convinced the prosecutors to let me resolve my case by entering a pretrial diversion program, allowing the charges to be totally dismissed and the arrest expunged from my record: the best possible outcome!!!
