Accident and refusal

In April of 2021 I got into an accident involving 2 cars and a house and I couldn't be happier with the work Mr. Fiandach and his team brought for my defense. My case had a lot of ups and downs involving the prosecution over the stretch of a year. Mr. Fiandach and his team handled these delays and th...e entire process perfectly which resulted in my case being dismissed. Couldn't be happier with my decision to choose Fiandach & Fiandach for my case.

Thank you for your five star review. Yes, this case certainly had, as you say, its "ups and downs." Nevertheless, we pushed on and obtained a just result. I enjoyed representing you, you were prompt for all appearances and understanding about all the little twists and turns that came to be. Best of luck to you in the future.

Potential for LIFETIME revocation, RESULT of 90 Day Suspension, Privilege RESTORED

In July of 2020, during the midst of the COVID-19 pandemic, I was charged with my 3rd alcohol related driving offense. In the back of the police car, I asked to speak to my attorney, Ed Fiandach. It was midnight on a Saturday and Ed answered the phone within a couple of rings. Ed explained to me... that because this was my 3rd offense within 25 years, I did not have the option to refuse the breath test at the station. The laws changed in 2012 and if I refused the breath test at the station, best case scenario I would automatically lose my license for 5 years and then I’d have another 5 years with a restricted license where I would need a breathalyzer installed to legally drive – a total of 10 years. These laws were new to me but I trusted his guidance. At the station I blew a .13. I couldn’t believe it, still completely in shock. Afterwards, I was dropped off to a family member’s house both ashamed and embarrassed. The next day, I began researching the new DWI laws that passed in 2012. It turned out that because this was my 3rd offense in 25 years and if convicted of the traffic violation I would be over 20 points on my license, I would lose my license for the rest of my life. If convicted of either of the two DWI charges (VTL-1192(2) or VTL-1192(3)), I would no longer be able to drive in the United States for the rest of my life. Ed’s advice to blow into the breath test at the station was my only hope. I needed to overcome the traffic violation and both DWI charges to even have a chance at driving again. If I didn’t blow that night at the station, my life would have been forever changed as I wasn’t aware of the new laws. I hired Ed Fiandach exclusively. I needed the best attorney that was available – I did not have the option for settling. Ed’s credentials are vast and long. He’s board certified by the National College for DUI Defense and has more awards than any other DWI defense attorney in the area. He’s written books, publications, has over 200 articles pertaining to DWI/DUI enforcement, and has given over 300 lectures on related DWI/DUI topics and defense. In my opinion, he is arguably one of the best DWI defense attorneys in the nation. After numerous court dates with Ed fighting long and hard in my defense, we ended up having the breath test suppressed due to a technicality in new laws, and I was offered a plea bargain to DWAI which I accepted. This meant I would be suspended for 90 days and I would not lose my license for the rest of my life. I remain fully convinced that without Ed Fiandach, I would not be driving again. His attention to detail, knowledge of both old and new laws, and his many years of experience were truly put to the test in my case. He’s seen it all but even with unique cases like mine he simply figures it out. Ed is a pilar in our community, an exemplarily DWI defense attorney, and many times the only hope someone like me has when faced with serious DWI allegations. Do not settle, hire Ed Fiandach and his team.

Thank you for your five star review and the time it took you to prepare the same. Yes, this was a case to remember! Virtually every issue I could think of turned up at one time or another. Particularly troublesome, was, as you point out, the very real possibility of a lifetime revocation. The facts of your case initially presented with a five year period of no driving, however, that was compounded by the driving record which could have imposed a lifetime bar and meant that we had to litigate in two different courts. I must say that I breathed a sigh of relief when all the many pieces presented by you matter fell into place. Good luck to you in the future.

DUI Case

My son was involved in a very serious single vehicle motorcycle accident in 2019 from which it took him two long years to rehabilitate. He was cited by the Geneva NY police for five different alleged violations, the most serious of which was alleged DUI/DWI involving alcohol and other substances. W...e hired Mr. Fiandach, who represented us diligently for more than two full years including a number of court appearances, meetings with officials, prosecutors, etc. The case was recently finally resolved in a manner exceedingly helpful to my son getting on with his life without meaningful legal history hanging over his head. I am extremely grateful to Mr. Fiandach and his team for their diligence, understanding, compassion to our situation, and dogged pursuit of a rightful outcome. I would recommend him highly.

Thank you for the kind review, Ken. This was a difficult case. It was a particularly emotional case fought in a very tough jurisdiction. My best to you and your family.

what did i just get my self into?

One thing led to another and i found myself in a postioin where everything i did in the past 17 years would be erased; I would have to start from scratch. My commercial drivers license, boating license and other credentials were hanging in the balance. I was in the mouth of the cannon - I couldn't fu...nction. I called one lawyer whom i never heard of, who's office is walking distance from my apartment. He told me he wouldn't take the case unless he could win so relax. I did realx for about six months and then i began to panic. I quit drinking since my "episode" and began to lean on my support group more then ever. I didnt want to make Mr. Fiandach's task worse so I gave the Judge absolutely no reasons to punish me further. I asked few questions, keep my mouth shut and trusted Ed. In due time the case against me was dismissed, I salvaged my career as a truck driver along with my life. Im eternally indebted to Ed and his secretary.

Thank- you so much. This was a very interesting case. When we first met, I thought the operation issue would easily carry the day, however through discovery, it evaporated and I had to find another way out. I enjoyed working with you, you always listened and followed my advice. Stay in touch and good luck in the future.
