The danger with the Internet is that it can be used to unfairly smear a person's reputation. No one in my office can identify this scenario. Agreements between parties are approved and signed before being filed with the court. Perhaps if this person would have signed their name we could address her issues as we do whenever anyone has a complaint or doesn't feel things are as they want.

Divorce / Child custody

Unfortunately attorneys cannot guarantee outcomes nor should they, and sometimes what we are told is not always factually the ways things are which makes it very difficult for the attorney. Joint custody is now the preferred option after the legislature changed the statute and it is entirely up to the judge, not the attorney, whether joint custody is ordered. When parties cannot agree the court orders the terms of a divorce and the signature of the attorney only approves the form of the order as was the case here. Clients are told they have 30 days to file a notice of appeal on a final order or decree and that was done here. This client timely filed the notice with another attorney, however, it appears not to have been followed through. Our retainer agreement states that it does not cover an appeal, which is very expensive and is a specialty in itself. All child custody and visitation orders can be modified if one of the parties is not abiding by the order or engages in conduct that is harmful to the child(ren). It is very disheartening to have someone nearly a year later feel they need to say such untruths.
