Words cannot begin to describe the gratitude and complete satisfaction that I have for Eric Mark. My story begins when I was entering JFK airport in 2-2014 from India and the Customs officer noticed an arrest from 2007. It was a misdemeanor and I had a conditional discharge of which I successfully completed. I never payed a fine or served any jail time. I received a deferred inspection in Philadelphia bc my 5 year old son was with me at the time.
I appeared twice in Philadelphia immigration court and both times they agreed that I did not have a deportable offense. They told me to fill out cancellational of removal papers and gave me a court date 7 months later. I missed the date of 3-3-2016. Well on 6-23-2016 ICE agents came to my door and took me away to Essex County Detention Facilty. The judge had ordered me deported in absentia for missing my court date for a non deportable offense. DEPORTED!!! Not a fine, not a couple of days in jail...DEPORTED!
While in custody for 3 weeks, I heard from one of the other detainees about an aggressive attorney by the name of Eric Mark. I hired Eric and he came to see me in ECCF almost immediately on a Sunday. He patiently took notes as I told him my story but mentioned that this could get ugly very quickly and took my case very seriously since the judge had issued a final order of deportation.
Within a week of that consult, on 7-24-2016, I was on a plane being duped about going to another detention facilty in Louisianna. Everyone told me that they don't deport to India and that if I didn't cooperate then they couldn't get travel documents but this is all a lie. This was an actual staging area for deportations which was right inside the airport in a converted hanger building. I called Eric immediately upon arriving there and he got to work throughout the weekend. 3 days later I was on an ICE plane shackled like a dog being deported along with about 85 other India and Bangladeshians. This plane had about 20 ICE agents to accompany us for the long 30 hour flight through California, Marshall Islands, Hawaii, Guam , Phillpipines, Bangladesh and then New Delhi India.
I went through every emotion my poor son, shock, disbelief, anger, resentment, depression, suicidal, and outright inconsolable sadness that after 41 years in this country and working as a professional that this is the end result.
As the plane flew from California borders, I gave up hope of any last minute heroics of a stay of deportation.
What I didn't realize was that my attorney Eric Mark was working hard and had almost never given up. He appeared before the immigration judge and thought that it was too late because my plane had already left the California coast. After finding out that my plane needed to make additional stops on US soil to refuel, he reapproached the immigration judge and convinced him to reopen the case because of the merits of my situation.
In a MIRACULOUS series of events, I was taken off the plane in Guam. The judge had agreed and accepted Eric's motion to reopen the case. I spent another month in Guam Detention. I finally was returned and my case was completely terminated the day before my hearing on 9-21-16.
