I have to tell you, this was another of those cases that, when you hear the charges, you say: WOW! this is so bad! I assumed this client was facing jail or prison time for this one. This client did so many things wrong that night and he'd willingly agree. It was one thing to drive that trashed. It's another thing to help his friend he was following in another car escape the scene of a crash. My client pulled his friend off a person's front yard where his car crashed into three others on the property, and left the scene in my client's car. But, for whatever reason, my client returned to the scene a little while later. By this time, police were everywhere. A description of my client's car was out there, and he was immediately stopped. What's worse, he was questioned by police and admitted everything. This case began in a municipal court. Due to my client's age, any plea would result in a license suspension. The prosecuting attorney was tough on him. I convinced him that a delay as long as possible was the best approach. At the last minute, we transferred the case to the State Court. That court, however, quickly had the case moving forward. After a great deal of preparation and research, an incredible plea deal was negotiated and agreed to. However, my client was still under age and still faced license issues. I had to beg the judge for one continuance and he very reluctantly agreed. He did this only after scolding me in open court about everyone wants delays, continuances, etc. By the time the plea deal was taken, my client was 21 and as a result, no license issues resulted. What an incredible result. This client's life could have changed, big time, had the events of that night just been a little different. He's lucky nobody was injured or killed (other than his friend). The client's doing just fine now and definitely learned his lesson.

I want to mention something I feel is important about this case: This client found me doing an internet search. We never met in person at anytime during my representation. This case was resolved by me for a very reasonable fee by making calls, sending emails, and providing the client detailed instructions on how to make a payment to the court to the reduced charge. What a great client! Thanks for the kind words. For those of you wondering, she pleaded Nolo Contendere to a reduced charge of reckless driving. The two counts of DUI were dismissed by the prosecutor. That reduction came, no doubt, only because of my very detailed motions that had been filed throughout the case. Especially those filed once the case was rapidly approaching trial by jury. These Motions in Limine challenged just about every result and decision made by all officers involved. Had this case gone to trial, the prosecution would have faced just about every legal argument under the sun. As a side note, four years previous to the plea, at the client's first arraignment, I offered the prosecutor a plea deal on a reckless charge and he said "our office doesn't reduce DUIs." Had the prosecutor accepted the offer, my client would have lost her driving privileges for one year due to her age. Four years later the state didn't reduce the DUIs, they outright dismissed them both! The lesson here, folks, is never give up. Fight criminal charges aggressively. Make sure your lawyer is willing to go the distance. You are the one that ultimately decides what to do. Don't let your lawyer pressure you into unfavorable plea deals. Good luck!
