It took me a while to get all the required medical documents together, but I got approved in the very first try. My own family doctor was hesitant about giving me disability for my back injury. He believed that I should get a disectomy (herniated disc surgery) so I could get back to work. My psych...iatrist absolutely refused to even fill any kind of forms that had to do with disability retirement -- a receptionist in his office told me that Dr. Jones doesn’t fill these forms because that encourages people not to work (however with fers disability retirement I can and I currently work without any penalties). At the end, attorney McGill wisely persuaded my primary doctor to cooperate. McGill also explained to me that the OPM can’t require applicants to undertake a risky surgery without any warranties. In the application forms (st form 3112), he stressed the fact that my doctor had said that without that disc surgery I could not possibly go back to work and made also some sort of case-law arguments to support his legal opinion that they could not possibly force me to take a dangerous surgery that will not guarantee me to get back on my feet.
