Helped me to retain 92 percent of my assets in divorce...

The process of divorce runs on two separate tracks and one of them is clearly emotional. It is in this emotional crisis that many of us are faced with the overwhelming task of negotiating what could be the biggest business deal of our lives. Andrew Benjamin was my attorney in a divorce that—on to...p of the usual emotional trauma—could have had devastating financial consequences. As a recently-retired executive, I had no pre-nup and an underemployed, unfaithful spouse with an over-inflated sense of entitlement. Before I confronted my husband, Andrew and I planned the best strategy for the outcome I wanted, aiming to protect my retirement plan and the assets I had accumulated. It probably would have been easy for a lawyer to ask the obvious questions—why did I marry this guy and what was I thinking? Instead, Andrew was respectful of my situation and dedicated to helping me navigate it. Still, the night I asked my husband to leave my home was one of the hardest of my life. The police were called in. I was deeply shaken the following morning when I met with Andrew to prepare to request a restraining order and file for a legal separation. I remember feeling like I was walking through someone else’s life. It was then that Andrew told me a story that I will not likely forget. It was about boxer Muhammad Ali, the Greatest, and his “rope-a-dope” fight with George Foreman. The fight was called The Rumble In the Jungle, and Foreman was favored for his raw punching power. Ali absorbed punch after punch, pummeled in the ropes by Foreman. Observers thought Ali would be seriously injured. Instead, Ali outsmarted Foreman, whose arms tired as the rounds wore on. Finally, Ali rose up from the ropes in the eighth round with a five-punch combination that staggered Foreman to the canvas. Now, why would an attorney tell his client a story like that? Andrew told me that story because he knew it was my time to rise up. And rise up we did. In a “50-50” community property state, Andrew was able to secure a division of property in a short-duration marriage that allowed me to retain 92 percent of my assets. Winning my financial security went a long way toward winning back my emotional strength. I consider Andrew to be a creative problem-solver with a clear head and a valuable depth of experience. He listens very well and asks the right questions to shape the case. He is able to analyze options and build the right strategies. In court, he is well known and respected by his colleagues; he acts with competence and confidence. He is flexible and aggressive. He considers his clients’ costs. And when it’s time to rise up, I can’t think of anyone better in the corner.
