This was this person's case "Dear Julia E. Simmons, I have received my 3rd DUI, and I am just over 4 years in to my 5 year deferment, I have a business, and I lose it all if I go to jail, I am being proactive, already in treatment and doing AA meetings, I have an alcohol bracelet on. I just need to talk to you about my options." As all my other reviews state, I'm very direct and honest in what people are looking at. If you review my reviews, you'll see that I've rejected cases because I believe there was absolutely nothing I can do. This client's case is BAD. She's on a deferred prosecution out of Mason county. The judge in Mason county is by far, the most difficult judge in the state and has a "No second chances" approach. I've seen this judge put out warrants and take in people for probation violations. In addition, she picked up a NEW DUI. She's already done her deferred. The stop in her case is valid. This means she's in a very very bad position. I told her, honestly, and I truly believe this to be the truth, that I don't think it's a "reasonable expectation that she not serve jail time ". Now, with that said, I've got a .49 BAC DUI, multiple offense, case dismissed.. and a 3rd DUI, Hit and Run with .29% BAC DIsmissed.....IT DOES HAPPEN... Just .. given her case and her case facts (being in mason), I don't believe it's a realistic expectation that she'll avoid jail time. So here we are, and I get a bad review for probably being the ONLY ATTORNEY to tell her the truth and tell her the ODDS of the truth. I going to email her privately. I think she's going to get a very rude awakening in multiple offense DUI law, and attorneys who BS you to get your money.
