H1b Visa

Just received H1b approval notice. I am not a STEM major, apply for a PR/Marketing position. I'd checked couple immigrant lawyers before Jay, all of them were really negative towards to my case. Jay took it without a hesitance, our communication was smooth, his job was perfect. I really appreciate.

Complicated Green Card filing for my wife

I am a US Citizen and was looking for an attorney to handle immigration process for my wife, who I met in China, and married in the US when she was visiting on a visitor's visa. My case was very complex because of the facts involved and difficulty in establishing my financial ability to support the g...reen card filing. Moreover, for the past several years I was traveling back and forth to China to launch my start-up business in the US. As a result my tax returns did not reflect financial ability to support an immigrant petition for my wife. Our wedding was very small and we did not have many wedding photographs or other evidence as usually required in these types of cases. I hired Jay Terkiana after my previous lawyer quit on my case. Jay was very responsive, patient and always attending to details. he filed the petition and informed me in advance about the issues involved and on what grounds USCIS will come back asking for more evidence. As predicted by Jay, USCIS came back questioning the exact same issues and also my financial ability. I did not have any joint sponsor. Jay suggested to respond to the RFE by presenting my net assets, cash in bank, and likelihood of success of my start-up business. USCIS issued a 2nd RFE, questioning the financial ability and the start-up business. Jay meticulously responded with great details and USCIS approved the immigrant petition. I would recommend Jay to anybody seeking a good immigration lawyer.

OPT Denial Reversed - Motion to Reopen Approved!!

I am an international student from Nigeria and studied in Minnesota. I had initially filed an OPT STEM application with a wrongly dated check. USCIS rejected it because of my error and requested a date-corrected check to be sent along with my application. The problem was, at this time, my OPT card ha...s expired by 2 weeks! My resubmitted application was eventually denied because it was submitted late. This was when I approached Jay Terkiana to help me file a Motion to Reopen (MTR), much against the advice of my DSOs and several attorneys who considered an MTR to be futile in most cases. One of my DSOs specifically said that the only successful MTR he has seen was due to USCIS error and not error from applicants like in my case. I spoke to Jay and discussed my case. He was nice to talk to and explained to me all the issues involved and how to handle them. I felt confident that he could handle my case. He filed a motion to reopen, with a very persuasive brief that I really liked. I think that is what did the trick. USCIS approved my OPT application and ordered the card for production, despite my late filing or not having an active I-20. I cannot be any happier. I highly recommend Jay Terkiana!
