OC Accident, Rear ended by drunk driver

My wife and I were involved in a devastating car accident. She was 7 months pregnant at the time. Our only recollection was waking up in a hospital with our families surrounding us. We knew this was a significant accident and did not just want anyone to handle our case. We spent some time doing o...ur due diligence and while there are many capable attorneys out there, Brian Breiter and his firm stood out to us. After speaking with Brian, it was clear that he understood our frustration in what’s happened in this accident, what its implications were, and how our lives would be different for some time. We wanted to pursue this aggressively in all ways and having an attorney that was experienced at trial and successful at trial was the key factor in choosing his firm (in addition to his great reputation). We worked with Brian and another partner at the firm, Timothy McCormick. They have been incredible at identifying and strategizing how the case would be pursued, the immediate steps for our treatments as well as road mapping steps to follow in preparing our case. My wife was left with a near volleyball size seroma on her thigh and needed multiple surgeries amongst other injuries. I had a concussion and severe bruising, as both my wife and I were found unconscious at the time of accident. We went through over a year of physical therapy, treatments, doctor visits, etc. We had discovered through the case that we were rear ended from a car that burned through a red light and was a drunk driver. In later toxicology tests and depositions, more substances were discovered to be evident. Overall, the case was lengthy and Brian and Tim did everything in their power to demand the maximum support from the insurance company to help restore my wife and I all the while seeking justice from the offender and never letting off to settle for anything less. At the end of it all, Brian and Tim delivered and we received the maximum support we were allowed in the policy. Our lives may not be the same from the accident; however, Brian and Tim did an outstanding job in representing us and fighting till the very end for our interest, justice, and chance to live normal again. We cannot thank you enough, thank you for helping us.

Brian was awesome! He helped me take care of the insurance claims process following my accident when I was a wreck physically and emotionally. The adjusters refused to budge until Brian worked his magic. The outcome would have been much different without him. Thank you Brian!

Cannot say enough good things about them. Top-notch team.

Contacted Brian and the team after seeing the great reviews on Yelp. A Toyota Tundra truck ran a two way stop sign and t-bone the driver side of my civic. Totaled in the process. Till today, I can still see and feel the heat from the grille from the truck. The driver not once did come by to che...ck to see if I was ok, and had the nerve telling others that I was speeding when others said I was not. While the fire department was using the "Jaws of Life" cutting the door, my pregnant wife drove by and saw the accident with me in the car with a drape over me to protect me from the glass and debris, but you can imagine what she was thinking. So to say I was livid is an understatement and wanted the best possible team to handle the case. My wife and I picked out a hand-full of lawyers to see and were on our way. Brian's office was last on list due to distance and we were so close to not going because I was exhausted over re-living what happened, luckily my wife is the voice of reason and convinced me to see Brian and I thank her enough for that. Brian's office just had a different vibe, it felt more like you were going to see a friend than an "ambulance chaser". From the first meeting, it clicked. We retained them right away, things just started moving. They would follow up with me regularly to let me know what was going on and frankly, I trusted them to a point when they would ask me what they wanted me to do, "I would just say I trust you guys, go with whatever you think is right". They handled everything from A-Z. I can't give the number but the result was 4x the amount of the best original offer. Big thanks to Brian, Jeff, Mark and the Team.

Great job

3 years ago I tripped on construction debris left behind by the maintenance crew for my apartment building. I remember falling forward but nothing more. I regained consciousness some minutes later. I was grateful for my Oral B electric toothbrush that night, doing all the work because I was pretty s...ure my arms needed to be glued back into their sockets. I woke early the next morning in bad pain and with new symptoms of an accident I couldn't remember. I was in this odd state of confusion during work and was all squinty-eyed trying to stay focused and failing. Even though I was dizzy, nauseous and my head hurt, it was the mind stuff that scared me. I hit the internet and read Yelp reviews and attorney websites for a couple of hours. I looked at photos that clients had posted. Some of the photos made me hesitate: my car isn't crumpled and my bicycle tires are still fully inflated. I don't have stitches, scars, or a plaster cast. I didn't call the police or an ambulance when I fell. I had a gash on one dangly arm and an abrasion on the other. I was confused and in massive pain, but neither of those photograph well. I didn't even have a witness. From my internet research, I selected a list of 5-star attorneys to call. The conversation with the first attorney was efficiently commandeered by him and went something like this: Attorney: So tell me what happened. Me: Well, I was taking some garbage out on Sunday night and I tripped... Attorney: Ouch. Okay. When can you come in? Scratch that dude (I didn't like his receptionist either). Next on the list was Brian Breiter's office. His staff handled my call perfectly. Brian and Mark Rubashkin, Esq. asked a zillion questions until they fully understood the accident and injury. I asked my own questions and made a few bad jokes. They didn't hang up. They made me feel comfortable and cared for. The three years since my accident have been hard. I was diagnosed with a bunch of bad stuff and take a bunch of pills. My daughter moved in to care for me. Sometimes I feel down. Sometimes I fall down. I understand the phrase "to battle fatigue" because sometimes I sleep for days. I gained 30 pounds from medication. I still have doctor appointments every week. Work is suffering because everything is so difficult. Through these hard three years, Brian and his legal team kept my case moving forward. My new life after the accident was so consuming of my attention that if Brian didn't carry my case, it would have gone nowhere. When my participation was needed, Brian was supportive and explained the legal processes and what was expected of me. Then one day the sun came out--Brian called and said the case was settled for the full amount. No trial, no troubles, no additional trauma: it was done. Working with Brian was so simple; I got to focus on getting well, and Brian and his team handled the rest. I would recommend Brian to anyone.

Don't hesitate!

I’m sitting still in traffic when a van plows into me from behind, totals my full-sized pickup, permanently injuring my neck, knocking me unconscious, and sending me for an ambulance ride to the hospital. Slam dunk liability, right? Wrong! The other driver’s insurance company completely ignored me. N...othing. Not even a polite response. Luckily, a friend told me to call Brian Breiter, who said basically, “Let me handle it.” And he did. Brian and his team made sure I got the medical care I needed, and they stared down the insurance company. Brian told me from the beginning it would take a long time – “They are going to drag this out and try to make you quit.” Well, it did take a long time, but we didn’t quit, and the other side eventually settled – just a couple of days before the trial was set to start. Call Brian! Or Mark or Jeff or Peter! They will take care of you like a friend.
