This case was settled over 2 years ago. I live out of state. I was recommended by three local lawyers to obtain a lawyer in GA, as this is where my ex husband lives and I would get higher child support. First, I told Yu about a large sum of money that I received for severance pay from the militar...y. She assured me to not worry because that would be considered joint property (something like that). Another is that I asked her if she was able to handle cases where the spouse has a military retirement, as I was supposed to receive 32.5% based on 13 years of our being married while he was on active duty. She assured me that she could. Anyway, she had me wasting time getting all of the medical bills (and medications-which are quite a few as my son has severe autism). I was billed for her reviewing these items, but none were used for reimbursement since my ex had left us 6 years prior. The $5000 retainer went quickly as she kept “reviewing “ my case. By the time I was out of money, of course I had to send more. I charged up high interest rate credit cards to pay her (the rates were high -29% because I had to file bankruptcy a couple of years after my ex husband left. By not agreeing to the terms that were offered by my ex spouse, we needed to go to trial. She told me she needed $10,000. I told her I didn’t have it. She then wiped her hands of me and all things were handled by her PA. I went into great detail about the things I needed and what was going on. Several hours I spent talking to the PA over a number of days. I called my lawyer asking her to call TSP (retirement for the military) as they would send her a copy of his history of what his activities had been, which I am sure my ex was taking money out. He had been putting over $800/mo into that account for years. When her turned in the letter from TSP, it stated that he had $9000 in there. She refused to do it. I could have proven that he was hiding money as well.
Ms Yu told me that my original payment amount was $275/hr, billed in 6 minutes increments. When we went to trial, it was beyond horrible. Before trial, after the lawyers had counsel with the judge, She came to tell me the judge was angry with me (unprofessional) and wanted me out of my house within 2 weeks. She plead my case for my son having special needs, so eventually it was changed in court that I had more time. I was so taken aback by my lawyer telling me the judge was angry with me for hiding the severance pay, (I put it away, because the VA told me I would have to pay a portion back and I didn’t want him spending it by telling me what to do with the money.). When I offered my ex some of the money, he said he didn’t want it.
During the trial, my lawyer asked him a few questions. She did not prepare me for what to do if my ex committed perjury, so I remained silent waiting for my turn on the stand. After my ex finished his side of the story as “plaintiff” she told me to take the deal that was previously offered because I could end up with much less. I took the settlement. I was supposed to receive 32% of his retirement after he was finished paying child support. She argued with me that by GA law, I was only entitled to 25%. She cost me over $400/month that I should have been receiving for the rest of my life. When I received the bill, she charged me $6000 for going to trial, without telling me the cost previously. When I couldn’t come up with $4800 right then, she and her PA told me they would not go further with my paperwork until I paid (I have proof through email). Not knowing GA law, you only have 30 days to respond. She emailed it to me the day before it was due to the court. we almost had to go back to court, which cost my ex and me more unnecessary money. I am still paying $200/mo. She told me I have to pay another lawyer $3000 for the retirement money (she did not know how to even though that is one of the first ?s that I asked) like it was no big deal.
