I have been on probation and paying restitution for almost 2 yrs, and probation is due to end in only 4 weeks. I recently recv'd communication from the probation department, asking me to "voluntarily" extend my probation, since even though I've been making all my payments, the restitution is not even... close to being paid in full. (I've only made a 10% dent in the restitution). I told probation I wouldn't voluntarily extend it and they told me they could violate my probation for not agreeing to extend it and for failing to make full restitution by the end of the two yrs. I consulted w/ Eric and he told me they CANNOT do that, as long as I've made all my payments and the normal course of events is that they would reduce the rest of my payments to a civil judgment. I then told probation that I consulted an attorney and he said they couldn't violate me and that it should be reduced to a judgment. Probation told me he was wrong and they could violate me, but she would discuss it w/ her supervisor and call me back. 4 days later, I got a letter from probation saying they would be filing a civil judgment agst me. HAH! If I hadn't sought advice from Eric, most likely I would have allowed probation to bully me into accepting the extension and they would have kept their iron grip firmly around my neck. I am willing to bet they do that to everyone, all the time and if I hadn't consulted w/ Eric, I would have let them get away w/ it, as I was scared to death about being thrown in jail.
