Legal advice on Small estate affidavit

We are talking about putting the house in my name, or selling and buying a new house in my name to avoid probate issues. Is this legal or is there a better way to do this? I've heard being added to a title is often not enough.

My mom passed in 2020 and the only thing she had in her name is a small savings account less than 200.00 and I’m her only child. I have the death certificate and her savings statement with her account number I’ve just recently got her savings account information. My question is can her bank do the small affidavit and notarize it or would I still need to go through the court to have this done? I did speak with the bank’s estate care center and they told me I could have all this done at the bank and I wouldn’t have to go to the clerk of court so I just wanted to find out and make sure.

A single man, died about a month ago intestate . His only child, an adult, wants to sell her father's property to me. The amount owed on the property is slightly less than the value, about $10,000 equity which would not even cover closing costs if sold on the MLS. Total assets are far below $75,000. It looks like the requirement is that it be 6 months from death to do a small estate affidavit. Two questions: 1. Since the property will go to foreclosure in a couple of months, can the 6 months be waived ? 2. Can she assign the property directly to me by small estate affidavit whereupon I can then pay off the underlying loan and have clear title?

My mother passed away a year ago and left a money market fund without a beneficiary. I am the executor of her trust but the money market fund was not specifically labeled in the trust.

How long does it take to get a letter of administration with a small estate affidavit? On the Surrogate's Court will search website. The person has been given voluntary administrator but there's not date of appointed.

This is a situation I presented here a couple of years ago. Basically the trustee of my fathers estate, who is a lawyer by trade but not acting as one here, paid himself about $240k in fees for the time period Aug 2019 until Dec 2020. He charged more after that time but those aren't relevant in this case. These fees came out of a checking account that owed no taxes, income nor estate. In Sept 2021 he finally filed the estates taxes for period listed above. This is when I discovered he listed "fiduciary fees" to the tune of $236,795 (52,000 for 2019, 184,795 for 2020,) which is close to the fees he already paid himself for the same time frame. When I compare the numbers on the tax forms to what I know happened with some of the money, they don't match. But does that matter? Is it OK to use money from one account to reduce taxes in the other? I'm still trying to figure out if the fiduciary fees are in fact the same as the other or they really are separate. Any insight would be great.

Can an estate be investigated

The bank is asking for either a small estate affidavit or letters of test (which don't apply, as I understand). The bank already has my certified letters of appointment for personal representative. How do I convey to them that the others do not apply so they will release funds to the estate and close the account? Thank you!
