Legal advice on Medical expenses for personal injury
Question: Is a $1000 for a accident that was not your fault for pain and suffering ? I was sideswipe from another car that was trying to get in my lane. She was 100% at fault her insurance want to give us 1000 dollars each for me and my wife. Is that fair we both have neck pain
Answer: Sorry to hear that both you and your wife were injured. Insurance companies typically offer minimal settlements early on to minimize the cost to them. Once you settle, they’re off the hook and you can’t go back for more compensation should you discover that your injuries were more serious than you initially thought.
If you’re both experiencing neck pain then chances are that your medical bills, which would likely include visits to an orthopedist and/or neurologist along with follow up physical therapy treatment, will far exceed $1,000 each. Furthermore, at this juncture, there’s no way of knowing what injuries you’ve actually sustained. Therefore, there’s no way of knowing what type of treatment you’ll ultimately need (physical therapy, injections, surgery, rehab) and how much loss of earnings and earning capacity you’ll have.
Not to mention compensation for your pain, suffering, loss of enjoyment of life and impairment to your activities of daily living.
