Legal advice on Inherited Roth IRA and estate planning

He is fine and remarried not even five months after my mom passed with her 401k. My mother's 401k should of been Spilt between us three like she wanted

How do I proceed? I want to sell. I have right of survivorship on the house. I have to sell. I can't pay all her bills. Taxes, insurance,rent each month. Her estate isn't worth much but he took everything I could sell to close out her accounts.

I listened to my divorce attorney's advice and contacted a QDRO attorney before we see the mediator. And QDRO attorney did the valuation part of our retirement plans and charged me $2000. The mediator recommended another QDRO attorney to finish the job and other tasks. I asked my divorce attorney to request $1000 from my ex in MSA for his share but she does not want to do it and actually she is not responding to me, I think she wants to quit because she is embarrassed that she referred me to QDRO attorney early and that could be her friend. Is it illegal that I make a deal with my spouse? I have to pay him some money from 401K (pre-tax) and he has to pay me same amount out of his savings. He wants us to waive the transaction. For me it doesn't make a difference to roll over to his IRA or waive. But if I roll over to his IRA someday, he has to pay taxes on it. And he has to pay me money out of his savings that is paid taxes on it. Can I in text or in private email to my spouse tell him if he wants me to waive, he needs to pay me $1000 his share of QDRO attorney? Is that possible to hire another divorce attorney at the very end time? MSA is almost ready.

My ex husband passed away. He had a Roll IRA with Fidelity. He named me as a spouse beneficiary during our 17 years marriage. Fidelity said I am no longer a beneficiary because I am no longer his spouse after the divorce. Fidelity stated the Roll IRA will go to an estate and I have to go through a probate. The total amount is $124,000. It is not even meet the minimum probate amount of $184,500. I want to know my right as a named spouse beneficiary.

My 68 yr. old schizophrenic sister is homeless in Chico Ca. She had a section 8 apartment but refused to sign the new lease and lost it. We have become estranged due to her behavior but I still worry about her. I am 79 and the only immediate family member she has. Thank you. Judy Spooner

My mother and father had a revocable trust. Both have passed. The trust identifies me and my two siblings as successor trustees. What must we do to open a bank account in order to gather assets, pay bills and taxes, and distribute the amount remaining.?

I have just recently learned the trustee and co-trustee covered their theft through my Dad's final income tax. They listed 3 death benefits and a IRA account (there was 2 IRA's and a CD) as income. Appears the beneficiaries received those funds, the trust paid the income taxes that were due. He stated the court had closed the trust was, we've not received a copy of the tax returns or a K1. The IRA accounts were put in their names prior to my dad's passing, as well as using our SSN's to claim death benefits, we were due. (his accounting shows they claimed all) I contacted the trustee to inquire about the 2021 refund and K1 not received, he said the IRS finally released the refund, with the trust being closed, he would receive the refund, and send us a certified check, closing the trust. To my knowledge, the trust taxes have not been completed due to trustees' failure to provide a copy of the will, amendments and trust, as requested as proof, after claiming he and the co-trustee, his brother were sole beneficiaries, until provided contradicting information showing us as the intended beneficiaries.

My boyfriend died and left a will. In it he gifted me his car and half the money in a trust he inherited from his mother. He gave everything else to his daughter who he had not spoken with for 15 yrs and made her executor. She cleaned everything out of the apartment I shared with him including my stuff the title to the car has already been given to me but not transfered she also took the car and I sent her message about the will and that she has what belonged to me and she said what her dad did died when he died and she went ahead and opened and closed his estate in one day and told the court there was no will. And she filed to be trustee of the trust account and will not communicate with me. I only want what's mine.
