Got tested came back positive for drugs but it was two days later of accident

I use recreational marijuana, and am sure that if tested by my future employer, I would pop positive for THC. Below, I have the Drug Policy Provided to me by the company. “Marijuana is an illegal drug under federal law even where it’s use has been approved by certain states for recreational and/or medical use. The use of marijuana will not be considered a legitimate medical explanation by (company) and its MRO for a positive drug test result for Marijuana, except where required by applicable state law. In addition, (company) will not accommodate applicants and employees use of medical marijuana, except where medical marijuana is legal under state law” “Applicants for certain positions may be required to pass a drug test with a result satisfactory to (company)* after they receive a conditional offer of employment. A refusal to submit to a drug test or unsatisfactory result will result in a withdrawal of the offer of employment. The company will not withdraw an offer on the basis of a positive result from an initial test that hasn’t been verified by a confirmatory test” *(Company) does not conduct pre-employment drug tests of applicants for marijuana.

Random DOT test. I didn't realize some pain pills I took would be considered illegal or expired if they're my prescription. I was fired after 10yrs and told to go to a drug program. And I can possibly get another job somewhere else. Period.

I got random drug tested and could potentially failed and lose my nursing license. How should I plan ahead and what i should do next while waiting on the result.

A company I applied to contacted me. I had three separate interviews with 6 different individuals and was offered the position: note, I was told in my third interview not give notice until I was made a formal offer of employment. Once given the formal offer of employment, I gave two weeks notice to my job and my new start date was to be March 8th. Then, the date was changed to March 15th, since they needed time to send me equipment. Post job offer they required three things: References, background check and drug test. This process seems backwards. After they received my "glowing" references I received forms for the background check and went for the drug test. I told them, that I unfortunately had a DUI in 2016. This was not a problem. However, the HR manager contacted after they received the report to inquire about it. After explaining it, there seemed to be no issue and I provided documentation to show I was under no probation etc. The next email I receive stated that wanted more details about my prior employers ( they were my references) and my alma maters and I was told I would now not be starting on the 15th and she didn't know when. I've given up a job for this .

I told my co-worker I was in therapy (cognitive behavioral therapy) and they told me they had to (and will) tell our boss about it and that it would result in a urine test. Is it legal for a co-worker to disclose this to my boss and can my employer force me to take a urine test because I am in therapy? Can my employer fire me because I am in therapy?

I have been offered a contract role with a company that requires drug screening as part of the employee background check. While this is not a full-time role it is a requirement they have in place with clients whom I would be working with, thus I am required to submit the test along with the background information. The company has temporarily slated me to start a project this month pending the screening results. The problem is I have THC in my system and am certain this would show up in the test. While my marijuana usage was off-duty it was not for medical reasons and I read the law allows a business to deny employment for a positive drug test results. My first question is, should I be upfront with the potential employer and let them know I won't pass? And secondly, if I were to go forth with the drug screening and fail will that appear on-record for future employer background checks? Thank you.

Employment Security Law section 34-8-194(2)(C) is the reason for the Georgia Department of Labor dening my unemployment claim. Sub-section (i) states: "The employer's burden of proof of just discharge or suspension shall be presumed met if the individual fails a drug screening test which is required by terms of the employer's drug-free workplace policy and said policy complies with the provisions of Article 11 of Chapter 9 of this title, other substantially equivalent or more stringent standards established by federal law or regulations, or with rules and regulations prescribed by the Commissioner." I was never drug tested.
