Legal advice on Federal crime in Maryland

With out going in to too much info as my last question was deleted by the site I assume for putting in too much information. I am being charged with theft & embezzle misappropriation. I have an arraignment coming up & I am not sure if I should enter a guilty plea or a not guilty plea. What are the consequences of both of them.

Expungement of Felony PBJ?

April of 2018 I took Alfred Plea for Felony. Theft. 3 year sentence with all but 30 weekend days suspended and 5 year supervised probation. I paid off restitution and supervised probation was removed. In August 2020. I was granted by judge 2 days ago (Dec 2 2022) modification from Guilty conviction to PBJ. January 13, I filed for an Expungement with Waiver/Release and ready to show good cause if a hearing is granted. Case Search says "Petition for Expungement sent to all parties/Stage 1". I understand that the States Attorney has 30 days to respond. My questions are: 1. Does the States Attorney usually object to an expungment? 2. If the States Attorney does NOT object does the court usually grant the expungement? 2. Is all above what Stage 1 means?

What can I do?

I filed a 2255 in Federal court one year and nine months ago. I called the Clerk of the Court who stated it is still under consideration. What can I do to move this along? Is there something I can file to bring it to the attention of a higher judge or committee?

Is a violation of probation a crime itself, or just a violation of probation?

Lets say that a friend had a DUI with a maximum sentance of 1 year. She violated probation and the original probation term was 3 years. Many years later, now she wants to buy a shotgun but is unsure if she can. The ATF form 4473 says "Have you ever been convicted in any court, including a military court, of a felony, or any other crime for which the judge could have imprisoned you for more than one year, even if you received a shorter sentence including probation? " Does she answer no to this or does the probation violation mean she has to answer yes?

What does officer scheduling mean?

On probation for Malicious destruction of property was on stet dock they’ve recanted to have it off the Stet dock after this, poss of marijuana less then 10 grams, fraud giving another’s name. VOP, possession of a loaded clip as well

When will the hearing take place and is it an order or more of a motion?

My fiancé had a VOP hearing scheduled Thursday June 23rd at 11:00am. Unfortunately despite the hearing being scheduled the jail did not transport him and the jail said his name was not in the system when the court said it was the jails fault for not transporting him to the jail. He’s been incarcerated for almost 2 months and it’s been excuse after another. On that day I am guessing his public defender did something because on his case search it says Writ Heabeas Corpus on the date of 06/23/2022. So far this week nothing is still getting done no new court date and they violating his rights left and right. I was wondering how long do they usually take and is there hope for him or does he just sit in there letting them take advantage of him.
