Legal advice on Elder law

I was reported falsely to Adult Protective Services for elder abuse least three times by my daughter-in-law. She accused me in a financial abuse (I took money from our joined with my husband account). She accused me in steeling his identity?! Now she accuses me in following him up. Nothing in true. How do they determine my innocence or guilt? Can I start a case against my daughter-in-law for making false reports?

Another option would be to buy another home again as co owners. Will she still be affected by the Medicaid look back period? There’s a lot of equity but most likely it will all be used for the new purchase given the cost of a home in our area.

My 75 year old Mom is in a Private Care Facility through an Umbrella LLC called Far Northern Regional Center, they have several different facilities for elderly care including care for mentally ill patients who need 24/7 nursing services in a home setting. I used to have full communication with my Mom as did her grand children, but about 2 months ago ALL communications were severed by Far Northern for reasons unknown and no warning or explanation was given. I reached out to Far Northern directly and left several messages for the supervisor of the care facility that my Mom was in to return my call to find out why we could not communicate anymore....not one (1) call was ever returned....so my Husband suggested for us to call the County Sheriff and have them do a "Welfare Check" on my Mom, they did, but were not permitted to actually physically see her to find out if she was ok, but they assured the deputy Sheriff that she was being taken care of in one of there Statewide facilities, but would not give her exact location. I was supposed to regain Power of Attorney with my Mom and as soon as that was found out by Far Northern, all communications were terminated.

My uncle is an attorney and is going to help with the estate planning documents for my mom, but he lives in different county than we do. He says, “The proceeding would have to be filed in the county where she lives and an attorney familiar with the clerk's local procedures should handle that.” When I called a local attorney, I was told in NC you don’t have to file the documents. Wondering who is correct. Also, can someone please give me advice on the best way to handle my moms estate. Different attorneys have told me different ways to handle it. Her estate consist of: -Townhome paid off $375,000 -Car paid off $13,000 -Savings account with $60,000 -SS $1700 per month. She is most likely going to end up with a dementia diagnosis in the next couple of months. She will live with me for a while but will eventually need placement in an assisted living or memory care. She has Medicare. I have MPoA. Thanks for any advice.

My parents have a pension social security and personal savings. My father needs in home hospice care and I want to set up a trust from their combined savings, of approx $300K for care for my Mother. Is this a good way to protect assets for my mothers care while we address the needs for my father?
