Legal advice on Divorce in Virginia

I’m in a abusive marriage. I am financially stuck. He will not leave and if he did I would struggle to pay the mortgage by myself. He threatens me daily that he is going to sell the house but both of our names are on the mortgage. I don’t know what to do. If the house is sold I will be homeless. I am in a lot of debt. I have no savings, no family to turn to, and no one to help me financially. Everyday it’s verbal snd emotional abuse. I don’t have money to hire an attorney and I’m over the income limit for legal aid. What are my rights? What can I do?

My current lawyer is asking what i want him to do with the divorce complaint that he said he filed. he asked. " in the Virginia Beach Circuit Court as I am counsel of record on that matter. I can withdraw as counsel so it will remain as a pending case or I can dismiss it since it has not been served." My husband force me to sign the separation paper work and its uncontested. wouldn't I be needing the divorce paper work that my lawyer said he filed? so would it be better to leave it as a pending case? do I have to pay while my lawyer while its pending?

My husband does not want me at home anymore. He tells me to leave all the time and has become verbally abusive. The trailer we live in together is in his father's name on his father's property. He had his dad tell me I couldn't come back. I've lived there since 2010.

Hello, My mom and my step-dad been married for years but five or six years ago, he married a second wife and put her in our house. My mom who was in Senegal at time, still married found out and came back but she was forced to live in an apartment since the other lady was in the house. I tried to convince her to report my step dad but she always refused, choosing to protect him for the sake of my little sister. For a month now we have been living in the house with the other wife and today my step dad crossed the line and physically abused my mom. She finally decided to report him but she wants to do it anonymously. What do we do? What do you suggest? It is important that everything remains anonymous. I am choosing to trust whoever is reading this please don’t do anything before contacting me. There’s a lot of reasons why we want this to be anonymous. We’re Senegalese and our culture heavily prohibits women to stand up and report anything their husbands do. Thank you.

Divorce granted 7 years ago.My ex hired the attorney who filed the paperwork in Gloucester,VA. I asked for/ received a copy of the certificate recently from Vital Records. The SS#'s are in the WRONG places- correct mumbers, but flipped in location. I contacted the attorney who prepared / submitted the document incorrectly- he cannot speak/help me because he represented my ex. - who is deceased now. I was told by them I need to hire my own attorney now to fix their ( the ex's attorney)mistake because it has to go through the courts to be changed/amended.

HI Folks, I have a very simple question. How much does an uncontested divorce cost in Virginia or any other state? Has anybody tried those online divorce websites or attorneys own online service? Are they any good?

If she moves out and retains a lawyer and they (attempt to) serve me papers, will that give her what she wants? How about if they are unsuccessful serving them to me? What if I would potentially fight her for custody in court because I have several accusations (with various evidence) against her for neglect, carelessness, questionable mental stability (she also has two sisters and mother with serious diagnosed mental illness, one of which she is a legal guardian to) and also concern that she would be sharing a new home with other people instead of getting a new home to herself? Until a court date, can I prevent her from taking our kids to another home? Also, could I have the option to move my kids with me several states away from here where my parents live? As a form of power/abuse, any time she disagrees with me about something, she has threatened divorce against me (1,000 times in 10 years) without ever actually taking action, just repeating the abuse. I have only put up with it and stayed in the marriage (with a lot of resulting anxiety/stress and some depression) because I fear for my children's well being if we were apart and she got any custody.

My husband and I have been apart since January 2015 when he was incarcerated until around April 2020. We have not lived together since then and have both wanted a divorce this entire time but he has continued to say he would handle it and has yet to do anything. So I am tired of waiting and want it over. Unfortunately, I am on a very limited income and can't afford an attorney and he once again is incarcerated until November 2023. We both are in agreement regarding the divorce and don't have any property or child custody issues to dispute, so it should be extremely easy, right? What can I do to have this over and done with as cheaply and quickly as possible??

Im going through a separation. My husband took my car in the middle of the night and won't give it back. It's in my name and so the police said that doesn't matter because it's marital property. Can I sign the car over to my mom and make him have to give it to her?
