Legal advice on Divorce in New York

My husband I have been married for almost 12 years in Ny. He was very abusive during the relationship. There are police reports and arrests to prove the abuse. 2 years ago I finally worked up the courage and strength to leave. I moved to California where my son was living. My soon to be ex filed for divorce a few months ago. I cannot afford an attorney. I have no savings and bad credit now too. We have come to a preliminary agreement but I feel it is unfair since I don’t even know what I may be giving up by signing this agreement. Are there any programs or organizations that can help me determine if our agreement is fair to me also?

I filed uncontested divorce with my ex-husband last June. He has Schizophrenia, which is a very serious mental illness, that was main reason for our relationship went wrong, he was mentally unstable and full of delusions. He often accused me of something for no reason. For that I went to therapist and I had been suffering in that relationship. Later on he cheated me with another woman who had money, who he claimed to be love of his life because she would spend for him. I filed divorce and right now the divorce is still pending, he reached out to me from last September, said he wanted to meet, I didn't respond to him because I was and I am scared of him. After one or two months he reached out to me again and said he planned to go back to New York, he wanted to talk to me. I didn't respond. I was so scared. He called me I didn't pick up. Yesterday, he text me and said" He left me because I tried to murder him for life insurance" OMG. He didn't even have life insurance, I was really shocked seeing that. I feel so fragile and sensitive, I am scared of him. I don't know if that is enough to request restriction order on him, he is mentally sick, I never know what he would do next.

My lawyer was negligent in that he did not collect discovery, missed pretrial conference and did not discuss my case in advance or give status updates. I was unaware of the trial date until days before. I live out of state and was not able to make it. A stipulation was entered without my presence that did not reflect our discussion prior to the stipulation being entered. Later, I did not sign it when I saw that it was blatantly wrong. After giving him an ultimatum to fix it, he withdrew counsel. How do I proceed with fixing the stipulation? The division of IRAs included those that were liquidated before filing. I would need the discovery to prove my wife already received compensation through the marital funds of that prior year. What kind of motion would I request? Reopening the whole case or correcting the stipulation or other? My wife put forth a nuisance motion for possession of the house with a false concern that I may bully her into a new agreement when I visit to get my stuff and stay in the separate studio apt. Thinking to reply with a cross motion?

Should my husband and I divorce who would get the house

Me and my ex wife was married in Australia 3years before, now we both live in China but broke up recently, I have Greece permanent residency(Golden visa), my ex wife has no relationship with Greek, is it eligible for me to apply divorce in Greek under this situation!? Thank you so much

My wife and I were not going to go after each other's retirement / investment accounts. Currently she has 236,000 ( 200,000 is separate property)and I have 36,000 (12,000 is separate property). During COVID and living separately I took a 10,000 loan against my IRA and liquidated 14,000 (11,200 after taxes). My wife was provided with 70-75% of the marital funds (primarily from my earnings) which more than covered what I took out. Three months before filing, I was given the option of receiving a lump sum or rolling over my pension (43,000 after taxes). I chose the lump sum given I could use the money in covering expenses in starting a new life, ie buying a house, paying for divorce. My wife signed off. Now 2.5 years later, my wife wants half of everything liquidated. How does equitable distribution play in with her having more money available for retirement , she signed off, received ample compensation and all done before filing? In addition she did not work or care for the kids through most of the marriage due to depression and completed her third degree paid for by me. She now works full time and continues to receive annual gifts from family.

Since amount of alimony is based on whether or not the lesser earning spouse can support him/herself is it a more fair situation if both spouses worked during the marriage or is the earning potential of the lesser earning spouse taken into consideration? Are his/her separate accounts and inheritance taken into consideration? If a prenup is considered invalid would all of the higher earning spouse's assets, even separate accounts and inheritance, unrealized capital gains, pension, retirement accounts be used in calculating amount of alimony to be paid even if they were considered separate assets in the prenup? Does not paying alimony just increase the amount he’d have to pay in child support?

Can the prenup stipulate that the price of the house and it’s appreciation belong to the purchaser alone if one spouse is responsible for the purchase of the house, no matter that the insurance, utilities, repairs are paid by both parties? If both spouses contribute to the purchase price of the home can the prenup stipulate that the price of the house and it’s appreciation belongs to both spouses only up to the percentage of their contributions? Can the prenup also stipulate that neither spouse lives in the house after divorce, but instead the house is sold? If one future spouse’s parents want to buy a marital home for the future couple is it better for them to have it prior to the marriage or does it not matter ?

Initially my husband was commuting to work in Maryland/DC area (he always kept a residence in Maryland because he works for the govt and they require it. ) Many years later living apart most of the time has taken a toll on our marriage. He recently filed for divorce through the Howard Circuit Court . The kids (12 & 13 years old) and I have always lived (never anywhere else) and continue to live in New York City. I know I probably should get an attorney in Maryland. I do not want to get divorced down in Maryland and/or have the child support case, etc. their either. Can there be a divorce in Maryland and a child support case in NY? What can I do? In addition, what can I do to bring case to New York? Thank you.
