Legal advice on Bankruptcy and debt in Ohio

Inoperable car, boyfriend said to get everything fixed and he will pay for it, I did so, he wrote me a check for almost $5000 and wrote “auto repair loan” in memo because he was thinking our banks might question. I have all documentation for use of funds towards auto repair. He won’t accept any payment or promises, stating it was a gift, all in texts. This was 6 months ago. I honestly would never have borrowed such funds as I am low income. My bills were current at the time. KBB value of car is approx $5000. I think the Trustee would inquire if he looks that far back. Opinions please on waiting to see if he does and then justifying leaving it off or including it? Not sure I’ll file.

Joint checking with 25-yr-old daughter set up when she was a minor. She does not live with me, maintains a high balance in her acct, many transactions, and I have NOT made any transactions under that acct. My own single acct is with the same bank, US Bank. Should she close the acct before I file? Should I disclose the acct? How should I handle to avoid legal issues with bankruptcy but also best protect her funds?

I filed Chapter 7 bankruptcy pro se. My landlord filed an eviction which became an automatic stay with housing court. I received a notice for a 341 meeting and I was the only one in attendance. I understand that creditors usually don’t attend. During the 341 meeting the trustee advised that I have a no assets case and said my case was closed. A few weeks later I received a letter stating that a hearing was held with my landlord and a judgment to remove the automatic stay was approved. I never received any letters in the mail regarding a court hearing outside the 341 meeting. I reached out to the trustee and asked for clarification on the hearing that took place without me being present, the trustee advised that he cannot assist me with this and there is nothing I can do. How can a hearing be held without me being notified or given the option to attend? I read online about procedure objection but don’t know if it’s a form or if I simply email/write the bankruptcy judge objecting the decision based on procedural objections for not being notified of the hearing?

I will be filing Chapter 7 bankruptcy by the end of this year but I was curious about preferential payments. I've been staying with my parents for 6 months. While here, I pay them $600 a month in rent. My name is not on lease. Would this rent be considered a preferential payment that a bankruptcy trustee could go back and demand they repay?

My father is having to file for bankruptcy, and due to personal reasons, he was going to sign over one of the two cars he owns into my name. We are unsure if he can still legally do this due to filing for bankruptcy in that it may look suspicious or something. After he signs it though, I live 4 hours away and he wouldn't use it nor would I give it back, because I actually plan on giving it to someone else once I no longer need it.

I provided my lender information that I was in the process of filing for bankruptcy but it was my desire to reaffirm the agreement for the vehicle in question. Well boom my car was repossessed 1 day before the filing was complete(pro se). Are the any legal actions that can be taken besides motioning the court to see about getting the vehicle back. Hi all. I live in Ohio and would be filing with the Southern District Court. I've been through the process a few times, but never ended up filing. I am currently planning to file, but I am confused on if I should file a chapter 7 or chapter 13. I have VA disability, around 3800 a month, my spouse who isn't filing makes around 1800 a month after taxes. We pass the means test to file a chapter 7, but the schedule j form would push me into a chapter 13. Is VA disability considered "disposable income"? I cannot find anything definitive online since the passing of the HAVEN act. It seems to say it isn't at times, but some information shows it is. Does anyone have experience with this situation? With the deductions and whatnot, we have disposable income that would push me into the chapter 13 under normal circumstances. Thank you for any information.

I had to file bankruptcy pro se and my landlord filed an eviction against me. However, I filed bankruptcy prior to my landlord getting a judgment against me. During the eviction hearing I informed the judge, my landlord and his attorney that I filed bankruptcy and my landlord attorney advised that she was going to file a relief against me. However, today at the 341 meeting I was the only one on the call and I never received anything from my landlord attorney. During the 341 meeting I answered all the questions and was told my chapter 7 is completed. I’m not sure what I need to do now since no one attended the 341 meeting as it relates to my eviction. Do I need to notify housing court that no one showed up?

Hello! We came home to a burnt up home on Easter after being out of town. We lost everything literally except what we had on our bodies. I have NOT filed for Chapter 7 bankruptcy yet but was hoping to next week. My question is will the insurance check be considered an “asset”? I literally have to replace everything as I’m a single mom so I’ve been waiting forever for the check to come. The insurance coverage I had was unfortunately only $30k, our claims adjuster said there was another $43k that we had in personal belongings that we obviously won’t be getting reimbursed for since I had such a low amount of insurance.

My family and I went through a hard time and I became behind on a personal loan that we had. Long story short they started court proceedings for the debt. We received a trial date of August 1st, and responded to the summons. Then we received a letter in the mail stating that a motion for a summary judgement had been approved on July 10th. Which canceled our court date. Then we received a letter from the lawyer that gives us 3 options to avoid garnishment. All 3 options I can’t afford at this time. One was to pay off the entire debt, one was to pay 25% of my earnings, and one was to get a trustee appointment, which I believe also takes 25% of my earnings. So I’m wondering what happens if I don’t fill out the form. Will the garnishment go to court? I ask because I want to know if it’s possible to lower the payment amount with the judge if there is a court hearing for the garnishment. I’m not trying to avoid paying, I just can’t afford for them to take 25% of my pay.
