Legal advice on Bankruptcy and debt in Nebraska

Each year at the discretion of my parents I receive a gift to the maximum amount allowed by the IRS . This money comes from their simple A/B trust. There are no scheduled distributions. How can I receive the money this year when I am about to file chapter 7 bankruptcy?

We have a bankruptcy (for medical reasons) in which the mortgage was not affirmed (we were required to include the mortgage)…We have been making the payments for several years (mortgage was discharge 4 years ago). We would like to have the credit report reflect that payments are still being made timely manner every month. Is there any case law showing where this has been done? The mortgage is with a big national known company and we have requested they report it and been told no however, they state we must continue to follow all the stipulations of the original loan. I don’t mind following the stipulations but, I would like it reported and with a note that it reported at consumer (us) request. Or are we just out of luck and the law protects the big corporations (they do fund politics) and our credit score not improve like it should?

Married 2.5 years. He has high credit card debt. I am not on those cards. We don't share bank accounts or loans.

We had a mortgage that was discharge and NOT reaffirmed a couple of years ago. We just found out they no longer report our payments to the credit bureaus as essentially there is no longer a mortgage agreement—which we understand the reasoning behind this. Part of the mortgage loan agreement was that an escrow must be held as this was a FHA loan. However we are told that we still must maintain the escrow through the mortgage lender because this is what is written in the loan however, this loan is not enforceable due to the discharge from bankruptcy (per the mortgage lender). Since this loan is no longer enforceable and they can’t even report payments to credit bureaus can they still require an escrow to be held by them even though the loan is no longer valid? This does not make sense as they seem to be picking and choosing as to what they want to try to enforce and what they don’t want to enforce to their benefit.

My sister and I bought a House together three years ago however while financing we couldn't get approved with me on the loan. I still paid the down payments, closing cost, basically all cost associated with buying a home. I have made all the payments online directly to the lender since the purchase. However since we bought the home my sister has gotten married and moved back to Florida. She would like to get out from under this loan do we have any options where she can somehow transfer to me or would she need to sale it to me and i would need to get approved for financing. Question also if she has to sale it to me do I have to pay all the same cost as the first time and can we get the payoff amount of her current mortgage loan and just make the price that? Also if possible where do i start to even find out what my options are, ask her mortgage company, get a lawyer, apply for a loan and see if i can even qualify now, i recently filed Bankruptcy and am working on getting my credit score up but is it even reasonable right after a bankruptcy to be doing this or should I wait another year?

I have a lawn and snow business and one of my local accounts here has filed for chapter 11 bankruptcy. is this something where I am forced to loose all the money that they owe or will I recoup some of it? should I hire a lawyer to represent my company or should I represent myself?

My father in law put my husbands name on his house and his bank accounts because he is a step child and he wants to make sure he gets his assets when he passes. Because of my husbands medical bills we may have to file bankruptcy. If we do, can our creditors take my father in laws house or money? It isn't much, but I don't want that to happen.

I had to file Chapter 7 a few months ago. I am current on all of my mortgage payments and I chose to reaffirm my mortgage. I tried to make my upcoming mortgage payment and my mortgage company is now refusing to take my payment. All through the bankruptcy I have been restricted from their website. I really want to stay in my house! What should I do if they are trying to force me into foreclosure?

My husband and I are being sued by a collection agency for medical debt from last year in the amount of 2968.00 The thing is I didn't work all last year due to personal and health reasons and my husband only made less than 10000 for the whole year. We got medical insurance as of January this year but he is still the only one working. He does have a better job now but we don't fully understand what they are doing or how to go about fixing it.

My father passed away at the end of 2018 and since then my mother has quit paying a lot of her bills while accumulating more debt. Both credit cards and medical bills. My brother and I are just wondering if we will be responsible for paying these when she passes. We live in Nebraska and are not really sure what the law is. We have looked up next of kin laws but they don't really talk about debt, just that we will get anything she has left, which won't be anything but we sure don't want thousands of dollars of debt either. Is there anyway we can get her to stop using her credit cards?
