Requirements for a valid Nevada Will
Who may Make A willIn order to make a will a person must be 18 years old or older and must be of a sound mind. A sound mind generally means that they have the capacity to understand that they are making a will or distributing their property.
Writing and SignedA will must be in writing and must be signed by the testator (the person making the will). A will may also be signed by someone else, if directed by the testator to sign on their behalf. The person making the will must be in the presence of the person signing on their behalf at the time the Will is signed.
WitnessesA will must be witnessed by two competent witnesses. The witnesses must sign the will. The witnesses cannot be beneficiaries of the Will. The witnesses can also sign a self-proving declaration or affidavit so as not to later witness in court they saw the testator sign the will.
