After you file for Unemployment, the DOL may schedule a call with you to determine what happened and if you are eligible for Unemployment. This is called an adjudication. They will schedule this call if the DOL has questions about whether you are eligible. The DOL may have an adjudication based on the paperwork from your employer and then will not schedule a call with you. All reasons other than layoffs will prompt an adjudication according to the DOL's website. You should continue to file for unemployment while DOL is making a decision.
How long will it take to decide?
According tot he DOL's website it may take up to 10 weeks to make a determination on the claim. They decide cases on a first come first served basis.
How will you know that the DOL wants to talk to you?
If you left your job or been fired for reasons other than lack of work, within a week
after filing your application, the DOL will send you a letter telling you that your claim is in adjudication. If the issue is about how you left your job (separation), the letter will include a date and time someone from the DOL will call to ask you questions about your claim. If the question is about whether you are able and available for work, DOL will mail you a form and ask you to send in more information explaining the circumstances. If you are filing online, DOL will provide this form for you to download. In some cases, the DOL may ask you to call the Contact Center. You should respond to the DOL's request for information right away and mail or fax the information back to the DOL as soon as possible, so that they have that information in the system to make a determination or follow-up with our scheduled call.
What happens when the DOL calls you?
The representative of the DOL will ask you what happened on the day you were fired or lost your job. They will want to know the dates that you were employed, what kind of work you did, the name of your supervisor and any other clarifications that they need. Your employer will not be on the initial adjudication call. If you cannot be available when the call is scheduled call the DOL as soon as possible to reschedule the call. If you miss the call the DOL may make a decision based only on what they have.
The DOL will send you a letter of determination that says you've been approved for unemployment benefits or explains why they have denied your claim. If the DOL denies your claim, the letter includes information about how to appeal. If your claim is denied and you decide to file an appeal, you will get a copy of all the documentation the DOL used to make their decision. During your appeal, you should continue to file weekly claims as long as you remain unemployed.
When will you get benefits?
If your benefits are approved after the adjudication, your benefits will be released the day after the DOL enters your determination into their computer system. Your benefits--and any back payments--will be automatically deposited on your debit card. If this is your first time filing, please remember that it takes about a week to create your debit card and send it to you.
