What is discovery and how will it be used in my Maryland medical malpractice case? Discovery is one of the most important aspects of a civil case. Discovery can also be important in criminal cases too.
WHAT IS DISCOVERY AND HOW WILL IT BE USED IN MY MARYLAND MEDICAL MALPRACTICE CASE?
Discovery is the tool used to gather evidence in litigation. Two specifics ways that discovery can be obtained is through the use of depositions and requests.
Depositions are hearings in which a witness gives sworn testimony to questions asked by both the attorney representing the side of the witness’s and any opposing counsel. The depositions are often audio or video recorded. The witness is sworn in by the court reporter who is present to take down, or record the witness’ testimony.
Requests are formal, legal ways of asking for something or an answer. Another useful discovery tool is a request for admissions. This tool is a series of questions sent by one side to the other which asks the responding party to either admit or deny the statements in each question. A request for production of documents is a legal avenue to formally request copies of tangible items, such as records, emails, reports, etc.
IS THERE A BENEFIT TO OBTAINING INFORMATION BEFORE MY TRIAL?
There are many other avenues to obtain additional information from a witness prior to the trial. These are a few helpful methods that ae used to flesh out the critical issues presented during litigation. By using these forms of discovery, the parties can begin to narrow the lingering issues presented for trial.
