What if the driver who hit me in Florida was drinking?

Well it's pretty clear that drivers probably at fault for the accident, so you're not going to have major liability issues. You may also be entitled to claim what's called "punitive damages". Punitive damages are set up so that when people who do outrageous acts, such as drink and drive, it's to send a message to the public they're not supposed to do that, and so you're likely to get punitive damages. Of course that may be limited on what they're assets are and who they work for et cetera, depending on the situation, but you can make a claim for punitive damages, but again punitive damages are going to require bringing a legal counsel.
