What do I do if someone sues me?
What do you do if someone sues you?
Immediately Submit the Claim to Your Insurance CompanyThe first thing you should do is submit the lawsuit to your insurance company. If the suit involves an automobile, then contact your auto insurance. If it involves your business, your commercial liability insurance. Anything else, you should try your renters and/or homeowners insurance. You would be surprised what may be covered under a renters/homeowners policy.
Immediately Obtain a LawyerIf you insurance does not extend coverage, they may provide you a defense lawyer. If not, you need to seek an attorney immediately. The first thing the attorney should answer is: do you need an attorney?
Answer the Lawsuit within the Time PrescribedThe last thing you want to do is NOT answer the lawsuit. To answer a lawsuit you need to file an "answer" in the court where the lawsuit was filed and serve it on the opposing party. If you do not you may be subject to an order of default and default judgment. At that point, you may not be able to fight the lawsuit on the merits.
