ATTENTION AND DISCLAIMER This guide is intended to give a general overview of the statutes, guidelines, rules and general issues one may wish to review before filing a petition for divorce. An ‘uncontested divorce’ is granted when both parties agree to the terms of the divorce without further litigating the issues. If the parties cannot agree to the terms of the filed petition for divorce, then the matter becomes a ‘contested’ divorce. Should a divorce become ‘contested’, there are additional statutes, rules and considerations that one should be aware of that are not covered in this guide. This guide is not meant to be a comprehensive information presentation. It presents brief explanations of general Utah procedural rules and laws relating to divorce.
