Traveling on Advance Parole

BIA Decision in the Matter of ARRABALLY and YERRABELLY, 25 I&N Dec. 771 (BIA 2012) dramatically changed the law on the international travel on Advance Parole. The BIA traveling on a valid advance parole does not constitute a departure for purposes of triggering of the overstay bars to admissibility
