A traumatic brain injury (TBI) is an impact to the brain that causes severe damage such as a concussion, contusion or penetration. The type and amount of force or impact will usually determine the degree of the injury. Many brain injuries occur due to accidents such as car accidents, motorcycle accidents and truck accidents, as well as medical malpractice. According to the CDC, an estimated 1.7 million people sustain a TBI every year, and TBI is a contributing factor to 1/3 of all injury-related deaths in our nation. Males are approximately two times as likely to sustain a TBI as females, and exposures to blasts are a leading cause of TBI among active duty military personnel in military zones. If the injury was caused by another person's negligence, you may qualify for personal injury compensation.

Medical practitioners have a responsibility to provide a standard level of care to their patients. When medical negligence results in a brain injury, the practitioner can be held liable for damages. The same is true for accidents caused by someone's careless or reckless actions when they result in injuries or fatalities. Our firm will investigate your case to determine if another party was responsible for your injury, and seek maximum damages for your losses through a medical malpractice or personal injury claim. This is especially important when a TBI leads to permanent disability or impairment, and a claim can include compensation for:

  • Medical care
  • Lost wages
  • Pain and suffering
  • Mental distress
  • Home care
  • Physical and occupational therapy
  • Rehabilitation

Insurance carriers will often delay or deny claims in order to avoid paying a fair settlement, and you must be prepared to defend your legal rights before you enter into negotiation with any insurance adjusters. For this reason, it is highly recommended that you consult with a Brain Injury Lawyer from our firm as soon as possible.
