Traffic Stop? Here's what to say and do!
A traffic stop can be a frightening experience for anyone. These are the top things to say and do if you get pulled over by the police.
Protect your rights with these actions at a traffic stop!1. Ask the officer, "Am I free to leave?"
If you are free to leave- go! If not, go to step 2.
2. Say to the officer, "I do not consent to any searches."
3. Say to the officer, "I want my attorney present for any questioning."
4. Say to the officer, "I wish to remain silent."
You must assert these rights out loud by speaking the words to the officer. Many traffic stops are recorded by a police officer's body worn camera and your assertion of these rights can make a big difference in a criminal case. Never resist when an officer places you in custody. Just know that you have taken steps to fight your case with your attorney.
What to do if arrested?Even if you assert all the rights listed above, you may be arrested. If you get arrested, call an experienced criminal defense attorney as soon as you are able. A defense attorney can work on securing your release from jail and will continue to fight to protect all of your rights.
