Tips 1 - 5 (Before the Trial)The First Tip is to hire the right attorney. Not all attorneys are the same and most attorney do not do hearings or trials although they may say they do. You need to hire a person that has a track record of doing hearings and trials and of winning them.
Second Tip: Fight the Statutory Summary Suspension. The Statutory Summary Suspension is the automatic suspension of your driver's license after 46 days from the date of your arrest. Although this is very difficult to win, because of the different standard of proof, it is worth fighting because you can obtain the police officer's testimony.
Third Tip: Whenever there is testimony, have a court reporter present. This means that when the police officer is testifying about what happened prior to and during the arrest, everything the police officer says is recorded by a court reporter.
Fourth Tip: After each hearing, obtain the transcript. This is the typed document of what was asked of the police officer and his or her answer.
Fifth Tip: If your attorney did not do a good job at the Statutory Summary Suspension hearing, meaning they did not ask many questions or seemed new to this, fire them and hire another attorney.
Tips 6-86th Tip: Take your time. Usually a DUI or Criminal Case will take 4 -9 months to complete. Don't try to rush it or your attorney.
7th Tip: Pay your attorney. If your not fully paid, some attorneys will keep the case pending because they are concerned that payment will not be received if the case is over.
