It is not a criminal offense!A speed camera ciation is a civil penalty, and not a criminal violation. You may avoid court by paying the fine. Transp. Art., Sec. 21-809(c)(3). The police agency mails the citation to the owner or driver considered liable for the civil penalty. Sc. 21-809(d). This is a rebuttable presumption that can be contested at trial. the ciation must be mailed withn two weeks of the violation by in-state registered vehicles,and thirty dats for out-of-state registered vehicles.
There is no State's Attorney at trial!In most Counties, it is the police department that provides evidence of the violation in court, and the operator's training certificate, and proof that the device was properly calibrated and set up to catch you.
You may request that the operator be present in court.
You may present evidence that others were driving your vehicle, at the time.
What the judge will do at trial.After hearing the police department's evidence, your questions for the department witness, and your own testimony, the District Court judge will make a decision. The judge can:
Find you "not guilty;
Transfer liability for the citation from the owner to another person;
Find you "guilty;" or
Find you "guilty," and lower the fine.
