Recent driving studies have confirmed what most intuitively know already: driving while texting on a handheld device is highly dangerous. Someone texting has to concentrate to such a degree that he or she loses the ability to remain safely alert to traffic around them.
As of January 1, 2010, 17 states have statutues and laws in place to ban texting while driving. In a liability court case, using a statutory violation as a platform to base a punitive damages claim is a possible theory that will be used.
