Standards for Supervised Visitation in New York State

Supervised visitation is appropriate where it is established that unsupervised visitation is detrimental to the child. Cervera v. Cervera, 50 A.D.3d 837, 855 N.Y.S.2d 658 (2nd Dept. 2008). Supervised visitation is necessary when there are extraordinary circumstances showing that visitation would be detrimental to the child's well being. Twersky v. Twersky, 103 A.D.2d 775, 477 N.Y.S.2d 409 (2nd Dept. 1984). There are clearly extraordinary circumstances in this case warranting a continuation of supervised visitation.
