Should You be Concerned if Your Disability Case is Scheduled for a Video Hearing?

Social Security recently proposed a change in procedure where you would lose the right to object to a video hearing. In a video hearing, you and your lawyer would appear in a local hearing office but the judge and vocational witness might be hundreds of miles away in a different state. Is this change good or bad for you?

As I discuss in this video, there are pros and cons to SSA’s increase in the use of video hearings. The biggest benefit to you would be a faster hearing date since SSA would not be limited geographically when shifting work burdens. Further, my experience has been that judges assigned to video hearing duty are usually very well prepared - my guess is that SSA gives these judges extra paralegal help that local judges may not have.

On the other hand, many lawyers I know dislike video hearings. They point out that when you are not in the same room as your judge, it is hard to establish a “human to human” connection and the judge might not pick up on pain behavior, extreme anxiety, bruising or other issues that should be relevant to your case.

One tip I always give to my clients prior to video hearings - remember that there will likely be a brief lag caused by the technology so be careful about responding to the judge’s question before he/she stops talking and always talk slowly, clearly and loudly so the judge can hear you.
