A huge mistake that can be made when a case is in settlement posture is for the client to think that they know more than the attorney assisting them to close the case out. I know this sounds like a given, but it is probably not going to be in the client’s best interests to actively work against their attorney.

When a person looks to hire a birth injury, or medical malpractice attorney, they are looking to use that attorney’s expertise in the given practice area. This means that the attorney will consult the client on the pros and cons of their case. It is not the role of the attorney to just, “tell the client the good news” about the case.

Finally, you must remember that the attorney that you have hired more than likely has dealt with the issues in your case. This means that the attorney will be able to draw from this experience to help you navigate settling your medical malpractice claim, which can be invaluable!
