Sentences for Common Offenses in Georgia

Georgia law gives judges enormous power over criminal sentences. Because of the wide range of possible sentences, hiring effective representation is critical.

The table below lists the possible penalties for common offenses. This table does not address parole eligibility or probation conditions. Generally, drug offenders parole more quickly than perpetrators of “victim" crimes. In addition, courts can order monetary restitution any time a victim is injured or her property is stolen or damaged.

Child Molestation

(1st offense) 5 years probation 20 years in prison

DUI (1st offense) 24 hours in jail, $300 fine 12 months in jail and $1K

DUI (2nd in 10 years) 72 hours in jail and $600 fine 12 months in jail and $1K

DUI (3rd in 10 years) 15 days in jail and a $1k fine 12 months in jail and $5K

Financial Transaction

Card Theft and Fraud 1 year probation 3 years imprisonment $5K

Forgery, 3rd degree 1 year probation 10 years in prison and $5K

Possession <1 ounce of

Marijuana token fine 12 months in jail and $5K

Possession of >1 ounce of

Marijuana 1 year probation 10 years in prison and $5K

Possession of cocaine, Penalties depend upon weight of illegal drugs and number of prior meth. or opiates offenses. The statute is too complicated to put into a table

Robbery 1 year probation 20 years in prison and $5K

Theft by shoplifting

< $500 of goods, first

offense token fine 12 months in jail and $1K

Theft by shoplifting

$500 of goods 1 year probation 10 years in prison and $5K

Theft by Shoplifting, any

amount,4th or subsequent

offense 1 year in prison 10 years in prison, and $5K

Theft by Taking or

Receiving, $1500 or more 1 year probation 10 years in prison and $5K

Trafficking cocaine or meth.

28-199 grams 10 years in prison and 30 years in prison

a $200k fine

200-399 grams 10 years in prison and a 30 years in prison

$300k fine

400+ grams 25 years in prison and a 30 years in prison

$1,000,000 fine

1st Degree Vehicular Homicide 3 years probation 15 years in prison
