Second Divorce: Facing a Later Life Divorce

Posted by attorney Charles Hofheimer

If you're facing a later life divorce in Virginia Beach, you have some unique things to consider. While, legally, a divorce plays out the same way whether you're 25 or 55, there are many practical and emotional issues to address, particularly if you're getting divorced for the second time.

As people age, they gain experience in all aspects of life, including relationships. While in past generations it was common for a couple to marry young and stay together forever, divorce doesn't carry the stigma it used to and partners are less likely to stick around in an unhappy union.

Thanks to advances in science and medicine, people are living longer and healthier lives. They're more active and better able to pursue their interests than ever before. This opens up doors to meet new people and form more romantic relationships and, sometimes, marriages well into old age.

Unfortunately, relationships sometimes end in divorce, and some people find themselves dealing with a second divorce later in life. In fact, statistics show that the divorce rate for second marriages is 67%, according to

Why is this so high? People in second marriages may have trouble integrating their respective children and extended families, or they may come into the relationship with more baggage than they're willing to admit. In some cases, second marriages are the result of “rebound" relationships, in which someone begins a relationship soon after a failed marriage. These types of relationships are often started for the wrong reasons, and this need to start over may not reflect a person's actual readiness to do so, causing the resulting marriage to be built on shaky ground.

Challenges of a Second Divorce

When getting divorced for the second time, you may feel like you're ready for it. After all, you've been down this road before and know what to expect. Still, no matter how many times you face it, it's never easy. The social repercussions of a later life divorce in Virginia Beach can be very difficult because at older ages people tend to have stronger ties to their community and friends, as well as grown children and grandchildren. Whatever challenges arise, try not to beat yourself up for a second failed marriage. These are not uncommon, and it doesn't mean you can't or won't have successful relationships.

Focus on your mental and physical health, and be sure to make time for yourself during the stressful divorce period. If you feel you need to talk with a professional, don't hesitate; therapists can help you put things in perspective and move on with your life.

Whatever the reason for a second divorce, it's important that from a legal standpoint you approach it in the same way as you would any other divorce. Arm yourself with good legal counsel and know your rights. In a later-life divorce, financial matters tend to take center stage, so be aware of what assets you and your soon-to-be ex own so that your attorney can work toward a fair and equitable divorce settlement for you.
