Sealing and Expungements
In Illinois, some offenses can be eligible for sealing or expungement to have your criminal history removed from your record. In order to proceed with this, you need to obtain a copy of your record.
Acquiring a Copy of Your RecordIt is important that you obtain your "Statewide Criminal History Transcript" from the Illinois State Police to begin the process of expungement and sealings This transcript includes every arrests and every convictions in the State of Illinois. These transcripts cost ~$15.
You may obtain this report directly through the Illinois State Police or go to any licensed live scan fingerprint vendor who charges a fee. There, you will be fingerprinted and your information will be sent to the Illinois State Police, who run a thorough background check, which you can pick up at a future date.
If you seek the fingerprint scan and a copy of your Criminal History Transcript the cost will be ~$30. Once the background check is complete, the police department will email you your report. In order to read your report, you’ll need to receive an online permission certificate and an encryption application for your computer or you can pick it up at a later date in the office where you ordered the transcript.

The ProcessOnce you obtain a copy of your record, an attorney will need to review to see which arrests and cases are able to be sealed, which cases are able to be expunged, and which cases are not eligible.
Once the Request is filed, all parties involved will be notified. This includes every arresting agency and every prosecuting agency. Parties will be allowed to file an objection to the request during a 60 day period.
A hearing will be set, any objections will be heard, and a judge will make a ruling at that time.
Sealing and Expungements are discretionary which means that the Court has significant authority in determining whether records will be sealed/expunged.
