Uniquely, in Palos Verdes Estates, and owing to its rich history, residential views are protected against obstruction not by the local municipality, the city of Palos Verdes Estates, but by the Palos Verdes Homes Association. ("PVHA") The view restoration process in Palos Verdes Estates is fairly straightforward, with few of the hurdles and limitations that are in place in most California cities. Palos Verdes Estates is "view friendly." PVHA is a non-profit corporation comprised of homeowners in a planned unit development that comprises the City of Palos Verdes Estates. A Declaration of Establishment of Basic and Local Protective Restrictions, Conditions, Covenants, Reservations, Liens and Charges was recorded by PVHA July 5, 1923. ("Restrictions"). Article V, Section 7 of the Restrictions provide in part: "Representatives of the Homes Association ... shall have the right at any time to enter on or upon any property for the purpose of cutting back trees or other plantings which may grow up to a greater height than in the opinion of the Homes Association is warranted to maintain the view ... "The PVHA Board of Directors has adopted a series of resolutions establishing a procedure for implementing the Association's authority to maintain views. PVHA Resolution 182 was adopted in August 2018 establishing procedures for view restoration applications. The PVHA procedures are based on applications by individual members whose views are being obstructed. PVHA does not have "view enforcement officers" who seek out view obstructions
