A lot of attorneys today still think that any attorney can handle a DUI. This could not be further from the truth. A DUI attorney must be skilled, not only in Criminal law but in Civil law as well. Additionally, they need to have a firm understanding of a vast array of issues including, but not limited to chemistry physiology, biology, and pharmacology to say the least. These problems require extensive legal skill, as well as scientific and technical understanding.
How many DUI cases have you taken to a jury trial? What were the results? Can I contact some of your former clients?
The defense of drinking drivers is one of the most difficult tasks in the field of criminal law. Although there are more heinous crimes, few are more unpopular with the press, the public, the courts and the legislatures than drunk driving. Grass roots lobbying efforts have resulted in stiffer penalties, relaxed constitutional safeguards and attitude reformation in the legislatures and the judiciary. This has caused the drunk driving trial to evolve from a simple and commonplace task, often delegated to junior associates in a law firm or recent bar admittees, into an area principally suited to those well-versed and well-trained in the complexities of alcohol related criminal litigation.

What defenses/problems do you see in my case?
Even at a cursory a good DUI/DWI attorney should have some idea how he is going to defend your case. If he doesn't it is likely he will take your money, promise the moon and then attempt to convince you to take a plea. The most prevalent myth about DUI's is that they cannot be won. Experienced drunk driving defense lawyers "win" most cases of first offenders when there is no evidence of a wreck or other manifest bad driving. The term "win" is in quotation marks here because winning may mean having the charge reduced to a different offense or otherwise obtaining a plea bargain that avoids a conviction. The availability of alternative plea arrangements for offenders varies from jurisdiction to jurisdiction. The national average for acquittals is about 50 percent for those accused of drunk driving if their cases are heard by juries.
How much of your practice is devoted to defending people who have been accused of a drinking & driving offense?
This is obvious, if this attorney doesn't practice in the area they are likely not aware of the long-term consequences or the recent developments in the area of law and as stated above will attempt to get you to take a plea that at first may appear to be a good deal It is only after the conviction, these clients soon learn what most drunk driving specialists already know: The penalties are not only serious, but like the Energizer bunny in the TV ads, they keep going and going and going. Consequences like license suspension, fines, community service, probation, mandatory counseling or alcohol treatment, and possible incarceration (even for first offenders) are well known. These cases also carry a plethora of other consequences that will confront the convicted driver days, months, or even years after. For example, in most states insurance rates for convicted drunk drivers will increase 500 percent to 1,000 percent above the premiums paid before the conviction (if coverage isn't canceled)
What are your qualifications regarding DUI/DWI? Do you have any formal training in the administration of Standardized Field Sobriety Tests (SFST) Brea
Again, as stated above how well trained are they? If they are going to be examining an Officer or lab-tech. they had better know what they are talking about. If they don't why are you paying them to do a job you could do.
