Product Liability


Product liability is the area of law in which manufacturers, distributors, suppliers, retailers, and others who make products available to the public are held responsible for the injuries those products cause. Although the word "product" has broad connotations, product liability as an area of law is traditionally limited to products in the form of tangible personal property. Thousands of injuries occur every year due to defective or dangerous products. The legal rules about who is responsible for these injuries are different from other personal injury cases (car accidents, slip and falls). This responsibility lies with the manufacturers and/or all the sellers of the product. In general a product must meet ordinary expectations by the consumer and when a product has become a danger, then it cannot be said to meet the ordinary expectations of the consumer. Under any theory of liability, a plaintiff in a product liability case must prove that the product that caused injury was defective, and that the defect made the product unreasonably dangerous. So you see a product liability case can be quite complex. They can also be quite costly as they often require the assistance and testimony of experts to establish fault. In the meantime the manufacturers and others who distribute and sell these “defective” products have argued that the only thing a product liability verdict for the plaintiff has done is added to the cost of their goods being sold and make the plaintiff attorneys rich. Then you have the businesses that seek “tort” reform from state legislatures and Congress in hopes of reducing damage awards.
