Most personal injury cases do not go to trial. Many settle. Some are dismissed before trial. The State of New Jersey is proactive in trying to encourage parties to personal injury lawsuits to arrive at a place where they can settle a case or, if not, be prepared to try the case expeditiously. A major component in the system’s shepherding of cases is mandatory arbitration.
