Potential or actual parental kidnapping of minor child/renA court has the authority to restrict visitation if there is a threat that a non-custodial parent will kidnap the parties child/ren. Such restrictions include: restricting a parent;s travel; restricting visitation; prohibiting removal of a child; ordering relinquishment of passports; imposing a bond; and entering an emergency ex parte custody order.
Kidnapping; parental and third partyBy statute it is also a crime for a non-custodial parent or other person to remove a child under the age of fourteen from the state with the intention of violating a custody order.
Punishable by fine of up to $2000.00 or imprisonment for up to three years.
