One unique way to avoid jail on a California DUI in Butte County

How much jail time might you face for your Butte County DUI arrest? The answer to that question will depend on several factors. DUI sentencing guidelines have mandatory and minimum jail terms. Depending on the circumstances surrounding your DUI case you may be looking at a minimum jail term of anywhere from 2 days to 120 days for misdemeanor DUI charges.

Now if possible, I always try to get my client’s charges dismissed or at least reduced to lesser charges that don’t have minimum jail terms. But every case will not be dismissed, and in some cases a client actually is guilty. If a client doesn’t have a good defense, my priority shifts to reducing potential penalties including jail time.

So if the court is required to sentence you to a minimum term in jail, does that mean I can’t avoid jail in my case? No. The good news is that there are some options you might be able to use to avoid jail time. This blog article is about one of those options that is often available for Butte County DUI cases and Chico DUI arrests.

The DUI courts in Butte County have approved certain outpatient alcohol treatment programs. In many cases the court will “stay" an order of jail time on successful completion of an approved outpatient alcohol treatment program. This means that if you enroll in an approved program you don’t have to go to jail. If you complete the program and don’t violate your probation the “stay" of jail time can be made permanent.

Some defendants charged with a Butte County DUI have managed to completely avoid jail time on a DUI with two priors. This offense has a minimum 120 day jail sentence. That’s 4 months in jail. The court can stay all of this jail time if a DUI client gets treatment from a certified addiction treatment specialist.

One commonly authorized program accepts medical insurance, and even has a sliding-fee.
