No Contact Agreement in Restraining Orders
Restraining OrderProhibits the restrained party from coming near the protected party. Protected party may call the police and have restrained party arrested for violation. Restrained party cannot contact or come near the protected party, giving the protected party further relief and feeling of safety.
As stated above, restrained party must report restraining order on employment application, restricting high clearance government contracts. If protected party had an intimate relationship with restrained party, restrained party will be prohibited from carrying or owning a firearm, again further restricting employment.
No Contact AgreementA contract between the parties that is, usually, filed in the divorce action since most restraining orders are a result of divorcing parties. The agreement is more flexible, allowing the parties to "fine tune" the provisions of their agreement, including other individuals and regularly attended places. It is enforced not through police but through the court through a contempt citation. Penalties for contempt include up to 6 months in jail and repayment of cost and attorney fees.
